Noncustodial parent lack of civil rights in relationship to child support

What are civil rights? This term has currently surfaced in the LGBT("lesbian, gay, bisexual, and transgender") community in relationship to recent attacks on various individuals that practice a certain lifestyle.

The Core essence to civil rights are freedom of speech, the right to vote, due process of law, equal protection of the laws, and protection from unlawful discrimination. If a person or groups of people are not allowed or denied any of these rights , the person, individual or group can make a gripe about their civil rights being violated.

In the case of the LGBT community, the attacks with no follow up by the police or law and discrimination can be seen as violations of their civil rights.

On the other hand,The African-American Civil Rights Movement (1955–1968) refers to the movements in the United States aimed at outlawing racial discrimination against African Americans and restoring voting rights to them.

Well, today the Non Custodial child support civil right movements wants due process of law, equal protection of the laws and protection from unlawful discrimination.

For example , Baltimore City Office of Child support is a privatized entity currently run by a company name PSI(Policy Studies ). The state of Maryland has no influence of the day to day practices of PSI and , PSI efforts to collection child support from non custodial parents. This leaves non custodial parents with unequal protection from the law and, the only due process given is based on PSI rules and not the law.

A classic example of unequal protection from the law is arrears collection and, the proof you have to provided to PSI. If you tell PSI, who is collecting child support for the state of Maryland, the arrears amount in their system is not correct. You as the non custodial parent has to provide proof.

One has to keep mind that most non custodial parents pay child through garnishment. Wage garnishment is the most common type of garnishment, is the process of deducting money from an employee's monetary compensation (including salary), sometimes as a result of a court order. Yet , the court can take a non custodial parents money but, is not held accountable for accuracy in collection. Yet, another example of civil rights violations that fall under due process of law, equal protection of the laws, and protection from unlawful discrimination.

Moving forward, PSI or any child support collection entity can cause harassment to your employer and in most cases the person that handles the wage removal from your paycheck is not an expert in this area of the law. This leaves an child support pay-or without protection of their civil rights.

In short, one can see how not accurate record keeping and no laws that protect non custodial parents can cause that civil rights to be validated. Most non custodial parents that pay child support have no law binding protecting them, has no agency(police body) to report the validation while the custodial parents has laws and an agency to help them. One can easily see how Non custodial child support paying parents need help with their civil rights.
